Key Developments in Crypto: Tornado Cash Sanctions Overturned, Trump Pardons Ross Ulbricht, and SEC Launches Crypto Task Force

In today’s crypto landscape, significant developments have emerged that may reshape the future of digital currencies and their regulation. A US court in Texas has overturned sanctions against the Tornado Cash protocol, former President Donald Trump has pardoned Silk Road creator Ross Ulbricht, and the US Securities and Exchange Commission (SEC) has announced a new crypto task force aimed at regulatory clarity.

Texas Court Overturns Tornado Cash Sanctions

A pivotal ruling from the US District Court for the Western District of Texas has reversed the sanctions imposed on the Tornado Cash cryptocurrency mixing protocol. Initially sanctioned by the US Treasury’s Office of Foreign Assets Control (OFAC) in August 2022, Tornado Cash was accused of facilitating money laundering activities associated with the North Korean Lazarus Group, which allegedly laundered over $455 million in stolen digital assets through the platform.

The sanctions led to the arrest of Tornado Cash developer Alexey Pertsev, who was convicted of money laundering by Dutch courts in May 2024. Pertsev received a prison sentence of five years and four months for laundering $1.2 billion in illicit funds via the protocol. However, the recent court ruling came after six Tornado Cash users appealed against the sanctions, arguing that OFAC exceeded its statutory authority in blacklisting the protocol.

Trump Grants Pardon to Ross Ulbricht

In a surprising political move, former President Donald Trump announced a full pardon for Ross Ulbricht, the founder of the Silk Road darknet marketplace. Ulbricht had been serving a lengthy prison sentence of 12 years, originally facing a double life sentence plus an additional 40 years for his role in creating the online platform.

In a post on his Truth Social platform, Trump stated, “I just called the mother of Ross William Ulbricht to let her know that in honor of her and the Libertarian Movement, which supported me so strongly, it was my pleasure to have just signed a full and unconditional pardon of her son, Ross.” This decision aligns with one of Trump’s campaign promises to the crypto community, though it was met with mixed reactions, especially given that he had previously pardoned many individuals involved in the January 6 Capitol attack instead of fulfilling this crypto-related promise sooner.

SEC Introduces Crypto Task Force Under Hester Peirce

In a bid to establish clearer regulations for the cryptocurrency sector, the SEC has introduced a new crypto task force following the departure of former Chair Gary Gensler. Announced on January 21, the task force will be led by Commissioner Hester Peirce, often referred to as “Crypto Mom” for her supportive stance on crypto regulation.

Acting SEC Chairman Mark Uyeda highlighted the task force’s objectives, stating that it aims to help the Commission delineate regulatory frameworks, create realistic registration pathways, develop sensible disclosure guidelines, and deploy enforcement resources thoughtfully. This initiative marks a significant step towards regulatory clarity in the evolving landscape of digital assets.
